Terms of Service
These terms are the agreement between you and [Company legal name] ("we", "us"), a business in Louisiana, USA, for the DigiCard service: the card builder, published card pages, short links, custom links and everything that comes with them (the "Service"). By using the Service you agree to these terms and to the Acceptable Use Policy, which is part of them.
1. Who can use it
You must be at least 18 and able to enter a contract. You may use the Service for yourself or for a business you are authorised to represent. You are responsible for everything that happens under your account.
2. Your account
There are no passwords. We sign you in with a link sent to your email address, so keep that inbox secure: anyone who can read it can edit your cards. Tell us right away if you think someone else has used your account.
3. What you pay, once
Publishing a card costs a one-time fee, shown at checkout, and the card stays live for as long as the Service exists. Premium is a one-time fee that unlocks every premium feature for life. There are no subscriptions, no renewals and nothing to cancel. Payments are processed by Stripe; we never see or store your card number. Prices may change for future purchases, never for something you have already paid for.
4. Refunds
If you are unhappy with a purchase, write to us within 14 days and we will refund it and take the card down. A card or account removed for breaking the Acceptable Use Policy is not refunded.
5. Your content
You own what you put on your card. You give us the permission we need to host it, show it to visitors, cache it, make the images and links work, and generate things like QR codes and wallet passes from it. You promise that you have the right to use everything on your card, including photos, logos and names, and that it follows the Acceptable Use Policy.
6. Links and addresses
Your card's link (for example digicard.app/your-name) is claimed when you publish and cannot be changed afterwards, because it gets printed and written to NFC tags. Links are first come, first served, and we may reclaim a link that is reserved, misleading, infringes someone's rights or breaks the Acceptable Use Policy. Short links and custom domains work the same way. A custom domain stays yours only while you control the domain.
7. Taking things down
We may disable a card, a link, a domain or an account, with or without notice, when we reasonably believe it breaks these terms, the law or someone's rights, or when a payment is reversed. We act on reports from visitors and on automated checks, and a person reviews every takedown. If we got it wrong, write to us and we will put it back.
8. Copyright complaints
If something on the Service uses your work without permission, send a notice to our designated agent at [copyright email and postal address] with the work, where it appears, your contact details and a statement that you believe in good faith the use is not authorised. We remove material in response to valid notices and may terminate repeat infringers.
9. What we promise, and do not
We work to keep the Service available, fast and secure, and we keep backups. But the Service is provided "as is": we do not promise it will be uninterrupted or error-free, and we are not responsible for what visitors do with your card or for third-party services it links to. To the extent the law allows, our total liability to you for anything arising from the Service is limited to the amount you paid us in the twelve months before the claim.
10. Ending things
You can delete your drafts at any time and ask us to delete your account and published cards by writing to us. We may end the Service with at least 90 days' notice, during which you can export your card content. If we end the Service early for reasons within our control, we refund purchases made in the previous twelve months.
11. Changes to these terms
We may update these terms. Material changes are announced in the builder at least 14 days before they take effect. Continuing to use the Service after that means you accept them.
12. Law and disputes
These terms are governed by the laws of the State of Louisiana and the United States. Any dispute is resolved in the state or federal courts located in [parish], Louisiana, and you agree to that venue. If a part of these terms is found unenforceable, the rest still applies.
